My car was rear ended by an uninsured driver with an insured car. Who is liable for my car?
ok well my car was rear ended in the freeway and the car was insured but the driver wasnt on the policy. I had to get a lawyer to fight my case and i filed a claim with triple A which is the insurance the car is insured with. The car belongs to the drivers wife, so triple A said their is no coverage since the person who was driving the car wasnt on the policy and they will only cover a driver who doesnt live in the same household as the owner of the car. So triple A sent my lawyer a letter saying they are not liable for my car. Now the driver of the car said he has a separate insurance on another car and my lawyer said this insurance should cover the damages of my car even if this wasnt the car involved in the accident. Im really paranoid because im a college student and if my car doesnt get paid for im going to be left with over $5000 in debt (hospital bills, towing yard etc.) does anybody know what my chances are of getting this resolved? or has anybody had something similar happen to them?
